Da Governator to text messaging while driving: Hasta La Vista, Baby

A while ago, Governor Arnold Schwarzenegger put into effect that all people using cellphones would have to be "hands-free" which obviously means either a speaker phone mechanism or bluetooth apparatus to be "legal". Since then, there have been almost 20,000 citations issued for people that have violated this--to which the head of the California HIghway Patrol says "I don't understand how everyone is not hands-free by now". Well, obviously.

And now--he is saying hasta la vista, baby to text messaging while driving. While the research overwhelmingly shows that doing the activity (which I will admit, I do from time to time and probably look like a swerving drunk driver half of the time) is not good and very hazardous (especially in my case), it has not been enforced as a law--until now. Offenders have to pay a $20 fine for the first offense and $50 for every one thereafter. My question is "How really do you know about texting?" I mean, couldn't you simply be dialing out even while you have a bluetooth as you are passing a police officer? How is there proof of this???
